Drivers License Appeals

If your license has been suspended or revoked due to excessive points, unpaid tickets and multiple alcohol related offenses let the Law Firm of James P. Montagne, P.C. help you.

Depending on the nature of the suspension or revocation relief can be obtained through either the Courts of the Michigan Secretary of State Department through their Drivers Assessment and Appeal Division.

Appeals to the Circuit Court in the County where you live are authorized for hardship license appeals only:

a. Points, accidents and incompetency;

b. Driving while license is suspended;

c. A first implied consent suspension;

d. Probationary license suspension; and

e. Physical or mental disability suspensions.

All other license appeals must be made to the Secretary of State.

If your license revocation is related to drugs or alcohol, you will need a substance abuse evaluation by a state licensed substance abuse counselor. We can help you with that placement. You will also need letters from friends showing community proof of sobriety who see you on a regular basis. We can help you with "sample letters" to fulfill the state's requirements.

We will go with you to the administrative hearing to plead your case and prove to the hearings officer by clear and convincing evidence that your substance abuse problem is under control and is likely to remain under control.

The Law Firm of James P. Montagne, P.C. can get you back on the road again.
